Welcome to HostIt ("HostIt," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at mypartyhost.com, our mobile applications, and any related services (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, please do not use the Services.
You must be at least 13 years old to use the Services. If you are between 13 and the age of majority where you live, you may only use the Services with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. By using the Services you represent that you meet these requirements.
HostIt is a party planning tool. It helps you create events, send invitations, collect RSVPs, organize guest lists, share details with attendees, and coordinate the things that go into hosting a gathering. Features and pricing may change over time. We may add, modify, or remove features at our discretion.
To use most features you need an account. You agree to provide accurate information, keep it up to date, and keep your credentials secure. You are responsible for everything that happens under your account. Notify us at support@mypartyhost.com if you believe your account has been accessed without your authorization.
When using the Services you agree not to:
We may suspend or terminate accounts that violate these rules.
You retain ownership of the content you submit to HostIt (event details, guest lists, photos, messages, etc. — "Your Content"). By submitting Your Content, you grant HostIt a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting purposes), display, and transmit Your Content as needed to operate and provide the Services to you and the people you share an event with. This license ends when you delete Your Content or your account, except where retention is required by law or for backup integrity.
You are responsible for Your Content and for the legal right to share it. Don't upload anything you don't have permission to use.
If you upload contact information for guests or send invitations through the Services, you confirm that you have a lawful basis to do so and that recipients would reasonably expect to hear from you about the event. You agree not to use HostIt to send commercial marketing messages to your guests.
Some features are paid. Pricing and billing terms are described on our Pricing page. Payments are processed by third-party payment providers. Subscriptions renew automatically until you cancel. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
HostIt is built on third-party platforms (including Google Firebase) and may integrate with third-party services such as calendar providers, social logins, and analytics. Your use of those services is also governed by their own terms and privacy policies. We do not control and are not responsible for third-party services.
Our Privacy Policy explains how we handle your personal information. Our Cookie Notice explains our use of cookies and similar technologies. By using the Services you agree to those terms.
The Services — including the HostIt name, logo, software, design, and content we create — are owned by HostIt and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended personal or business purposes. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code, unless laws prohibit those restrictions or you have our written permission.
If you send us suggestions or feedback, we may use them without restriction or compensation to you.
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if we discontinue the Services. On termination, your right to use the Services ends. Sections that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and dispute resolution) will survive.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DATA WILL BE PRESERVED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTIT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
You agree to indemnify and hold harmless HostIt and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of (a) Your Content, (b) your use of the Services, (c) your violation of these Terms, or (d) your violation of any law or third-party right.
We may modify these Terms at any time. If we make material changes, we will update the "Last updated" date above and may also notify you in-app or by email. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
These Terms are governed by the laws applicable in the jurisdiction where HostIt operates, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of competent jurisdiction in that location, unless mandatory consumer-protection laws in your country require a different venue. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.
